E-1 and E-2 visas are established by commercial treaties between the U.S. and certain other countries and are only available to the nationals of those countries. These visas provide unique benefits to people who carry on certain economic activities within the U.S., as follows:

  • Treaty trader (E-1) visas: E-1 visas are available to high-level employees of companies that conduct substantial trading activities between treaty countries and the U.S.
  • Treaty investor (E-2) visas: E-2 visas are available to investors who make substantial investments in the U.S. and hold controlling interests in those investments.

The holders of E-1 and E-2 visas and their immediate families may live in the U.S. while conducting their trade and investment businesses. These visas are valid for two years but may be renewed indefinitely. Holders of these visas may also be eligible to apply for green cards.
