The deferred action initiative was announced by President Obama on June 15, 2012, and U.S. Citizenship And Immigration Services (USCIS) began accepting applications on August 15. This program is partially modeled on the proposed DREAM Act, which remains stalled in Congress.

Because deferred action is an executive branch initiative, it does not go as far as the DREAM Act would go in creating a path to citizenship. However, it does provide some important benefits. If you meet all of the following criteria, you may be eligible for deferred action:

  • You entered the U.S. before the age of 16.
  • You have lived in the U.S. continuously since June 15, 2007.
  • You were under the age of 31 as of June 15, 2012.
  • You entered the U.S. illegally or your legal status expired before June 15, 2012.
  • You are currently in school, have graduated from high school, have received your GED certification or have been honorably discharged from the military.
  • You have not been convicted of a felony, a significant misdemeanor, or three or more misdemeanors, and you do not pose a threat by remaining in the U.S.
  • You were present in the U.S. on June 15, 2012, and at the time of your application.
